Header width & js scripts

Hello, i'm working with this great theme and found something strange and can't figure out how to fix it. I'm using the fluid version.
If the minimum width is set to 800px why when viewed at less than 960px in the header area appear those blanks spaces on the right.
In the file attached is an example of the problem i'd like to solve.
Should the header have thosoe blank areas when going under 960px?

Antoher bonus question is:
How do I add the SwfObject js library to the fluid theme.

I've read that in the info file with
scripts[]=swfobject.js
with the swfobject placed in the fluid folder but something is not working.
