i jsut downloaded 6.2.9 and this patch was not in thecode.

I think the patch for 6.x-2.8 version by hop (not included in 2.9) is too much destructive or restrictive.
There are certainly cases where you don't want to prefix all phone numbers with country code no matter what you've set in field settings.
Here's the patch that solves this same issue that is still existing in 6.x-2.9 version.

I have to reopen this issue because the patch didn't get to the release correctly.
So I'm including my patch once again, this time against the current 2.11 version.
I hope this will be for the last time.
