The situation: I'm preparing an xtemplate-based theme for an organization that would like to limit use of the design content (images, etc.) to non-commercial. Is this possible when posting on drupal.org?

All releases posted on drupal.org need to be GPL; but the GPL is for software, rather than, e.g., artistic design elements. For artistic and other creative content, the various Creative Commons licenses provide good options.

So the question: can a theme be dual license: GPL for code, Creative Commons for creative content?

I think your best bet is to ask the CC people themselves as IANAL (and I doubt many others here are lawyers either) and it seems that they would know best about this sort of thing. I'm not sure about asking the GNU people, you can always email them I guess.
