There are a few instances where an email address can't be required for users. After some discussion on the ML and #drupal it was agreed that logintoboggan is really the place to implement this.

I have a patch to user.module in 4.7. I'll port this to a logintoboggan patch if I can find some time.

Is this still desired? If so, could you please make the patch available? If you don't have time to port it to logintoboggan, it's something I should be able to do.
