I can see that there's no warning now when I trying to create new preset with old name. The new preset just rewriting the old one.
That's not cool I think.

The logic was sort of there, but there was a typo in the export_type property:

  if (!empty($existing) && (!$form_state['values']['preset_edit']) && ($existing->get_type & EXPORT_IN_DATABASE)) {

Should be

  if (!empty($existing) && (!$form_state['values']['preset_edit']) && ($existing->export_type & EXPORT_IN_DATABASE)) {
