To reproduce, create a cck text field with a maximum length of 256 characters. Ask devel generate to create nodes with that cck field and it will bypass the restriction.

If true (I didn't check), his would be a bug in cck's integration between devel_generate and text module. That integration has moved to devel for D7 but is in CCK for d6.
