Remove footer signature if comments are read-only or disabled on the node

I thought this would be rather impossible, but Mail Comment sends out an email with "comment above this line" etc., even if I close comments (set them to "read only" instead of "read/write") and save a node.

Any way of changing the code a little so that Mailcomment first checks if comments are still permitted in a node, before processing stuff?
