This seems to be a derivate of a work that is distributed under the CC-BY licence, as mentioned here on the original download page by the original author of the theme. AFAIK there is no way to re-define the license. In particularyou are not free to remove the styleshout.com link on pages, because this hurts the priciple that you have to respect the manner, in which the original author wants you to link back to him. Having not this freedom on the other hand hurts the GNU license.
OK - I'm not a lawyer. But I would say, that's an issue, and a critical one, because users remove the ads inside pagel.tpl.php while thinking, that's OK and due to GNU license.

I don't know what the next step should be. Should the project page unpublished, or should the page still be visible, but report a warning about the theme being removed because not licensed under GPL? If the second option is the correct one, should the archives be removed, and the releases disabled?

avpadernoI have removed the archives containing the code, added an explanation on why the files have been removed from drupal.org, and changed the input format to full HTML.
