False positive of a blank "no file" upload

It has to do with file attachments and a false/fake positive result of a "no file"/blank attachment.

All modules except Upload we disabled and the "problem" still exists; also confirmed by a few other people in #Drupal irc.

1. creating a new blog and book page, or another node that allows for attachments
2. jump down to attach file
3. browse to file
4. click attach
5. file attaches
6. click attach again (with no browse to file)

A false positive file attaches and results on screen; no entry in files or upload table.

Already searched the bug reports and didn't see this particular one in there.
