What a lovely theme!
Local tasks - i.e. third-level navigation - on pages show up as tabs at the moment. I'm thinking of things like the View and Edit which appear on any page or article where the user has edit rights.
Most UI designers would say that tabs should be used to switch between in-place activities: they mimic card files, and users expect them to behave this way.
Overlays are great, but one of the UI problems with them is that they are not in-place activities, so tabs are inappropriate triggers for overlays.
I suggest that you style the local task tabs as buttons, so that they don't break the mental model that a user has for tabs.
My suggestion, is that visually, perhaps they should be buttons with styling that hints of overlays. Perhaps overlay gray might work?
