jquery.overlabel.js is not being loaded on my Access Denied pages causing the login form to lose its inline design and label appear/disappear effects. I thought maybe it was to do with subtheme inheritance but this occurs on Fusion Core as well.

Did you check permissions on the file/folder on your server? Haven't run into this in a default install...
