Groups collapsed when "opt-out" option is selected on a list

I found a problem when a list is selected a "opt-out". When a new user is registering, the list is selected by default, but the groups for that list are collapsed. You have to either click the title, or de-select and reselect the list so the groups expand.

With this behaviour (which I guess is not the intended) no one sees the groups, and no one chooses they preferences.
They should be expanded by default.

Problem is that $is_subscribed is not set to TRUE.
