My page wasn't validating correctly because in line 70 of the page.tpl.php file the anchor tag has an invalid attribute "name":

That was copied from Fusion. I'll try to get it fixed if I do one last release of the theme based on Fusion. However, due to lack of support of Fusion and Fusion Accelerator I'll be moving the theme onto a different base soon. Thanks for the post, though, and I'll work in the change if possible.
