trademarks and copyrights are different things. Do you object to the files containing a trademarked name/logo or to the copyright on the contents? If we say attachments can't contain trademarks we'll have a lot of work to do to clean that up.

What is the exact problem with those attachments?

They have no relevance to xmlsitemap and probably not to Drupal. When I first opened the document I had a WTF moment. I finally found the permission to distribute statements for the license. However, the files should not be allowed since one they cause disk usage for no good reason and two they may cause load issues as others find the files via a search on the net. I see no good reason to keep the files which are describing a "Reference Architecture for Service Oriented Architecture".

I've modified the title to remove the reference to trademark issue since it is not pertinent.

Disk space is a resource worth preserving.

Human time is also a valuable resource. Deleting files takes time that doesn't seem worth spending. With the d7 upgrade we've got an easy option: hiding files. I've hidden the files for now so they can just be forgotten.
