This is with a fusion based theme and we are using pseudo elements which I understand may not be supported by the mime mail compressor, based on Emogrifier but would that be causing all these issues?

Hokay, after further investigation I note that there are pseudo elements in system.css which is a default D7 file, does that make this module unusable in D7 then?
