chrisjlee CreditAttribution: chrisjlee commentedUpdating to the dev version of this solved problem for some strange reason. I also updated the custom build of modernizr and copied it over to
/sites/all/libraries/modernizr
Oh well. maybe this will save others from issues.

rupl7.x-3.0 has been released so upgrading to latest version will fix it. See #1919796: Modernizr module chokes on Libraries API 1.x
