Modernizr is a library scripts and CSS can depend on, there is no need to add it on every pages.

Seems to be working.

This applies and works as expected.

Modernizr is not loaded until called for (currently only by contextual module: this works).

So, no scripts loaded for anonymous users on a clean install! Win!
