you can use my patch in the attachment.

the reason why this "Undefined index" notice appeared is couresd by the variables "menu" in the theme function.
so i add a condition in .module line 493

if (!empty($mlid) && !empty($menu)) {

Hey mate, thanks for posting this extra conditional. Had the same issue with Internet Explorer 11 trying to render my page. Did not get the error in Opera though. Guess it pays to check your site's appearance in multiple browsers.
