1) why isn't the theme pushed down when the toolbar is enabled (like evry other d7 theme)
2) why is the background/header looking weird when visiting a page
3) comment permalink need to be removed or something has to be done about it

Fixed in the most recent dev snap shot. The issue was the theme and tool bar were using a fixed positioning. However, I advise anyone using this theme to have different admin theme enabled.

Yikes, that's actually using the default template from core so I just added a custom template and committed the fix.
