jquery update not referencing correct jquery_update files

I checked source from browser and jquery_update isn't replacing this:

I am using dev version and installed in /sites/all/modules/jquery_update

because this doesn't work, i cant add poll items for example because it breaks

is anyone going to fix these jquery_update bugs? there's way too many of them being ignored.
