Various errors with PHP 5.3

I'm seeing these errors on 5.3 with the recommended release 6.x-1.8 :

warning: Parameter 1 to theme_imagecacheactions_rgb_form() expected to be a reference, value given in /home/tp4/public_html/includes/theme.inc on line 668.

array_merge() [<a href='function.array-merge'>function.array-merge</a>]: Argument #2 is not an array in /home/tp4/public_html/sites/all/modules/imagecache_actions/utility.inc on line 405.

I can see the code amendments suggested in the following rather confused and now closed issue here http://drupal.org/node/872282, but shouldn't these issues be fixed in the module proper as most shared hosting companies are gradually migrating to PHP 5.3 ( often without informing their clients ) ?
