The same issue has been resolved for the Marinelli theme using the patch supplied above.

Just flagging that there's a patch available for this issue above, in case anyone gets trigger-happy in here.

My aim in filing this ticket was to resolve the license violation, not to cause trouble for users by having the theme removed following lack of maintainer response!

I'm confident clear heads will prevail of course :)
