On logging in I noticed the active tab is still gray, the border bottom is missing but the background should be white.

I can't confirm this with HEAD. IE8 and IE7 (compatibility mode).

Maybe there was some change here, only it looks even worse now in IE7.

I am able to reproduce the visual error in the bug description regardless of browser, so this is not a IE7 specific issue. There is a markup difference between /user and /user/login (when not logged in) that causes the different styling. See the attached graphical explanation.

There alrdy was an issue for this.
If you change the background color from white to something else you'll also see some border color issues.
There is a patch that need review/some work maybe. #860136: tabs go half-active when below them
