Unfortunately you have to defend a trademark. You can't just expect people to adhere to it. You have the legal right to shut down any site using the Drupal name and riding off the brand. However it costs money. The longer you leave it the harder it is to undo the public right to continue to use it. The first step would be to start issuing warnings, block site users who fail to adhere to the warnings and go from there.
Drupal association trademark policy is pending
The Drupal community has been defending the trademark for a while. The Drupal association has a solid history of contacting people about trademark violations and informing them they are in violation. The trademark is clearly stated on http://drupal.org and the association is working on a trademark policy with legal council including a fair use policy.

Proprietary rights in relation to a trademark may be established through actual use in the marketplace, or through registration of the mark with the trademarks office (or "trademarks registry") of a particular jurisdiction, e.g., the U.S. Patent and Trademark Office. In many jurisdictions, trademark rights can be established through either or both means. Certain jurisdictions generally do not recognize trademarks rights arising through use (e.g. China or European Union). If trademark owners do not hold registrations for their marks in such jurisdictions, the extent to which they will be able to enforce their rights through trademark infringement proceedings will therefore be limited. Once trademark rights are established in a particular jurisdiction, these rights are generally only enforceable in that jurisdiction, a quality which is sometimes known as territoriality. However, there is a range of international trademark laws and systems which facilitate the protection of trademarks in more than one jurisdiction (see International trademark laws below).
The most important phrase is this: "The test is always whether a consumer of the goods or services will be confused as to the identity of the source or origin." This is not helped much by the fact that you have Dries's trademark message on your site too. Since you do not own the trademark you do not own the right to display it. A trademark is reserved for use by the trademark owner, since it is their property. A trademark can be bought and sold but at present as far as I know Dries is the current owner of the Drupal trademark.
Basically it wouldn't take much to determine that Drupalpoint, operating as a brand of software developers is in breach of trademark, within the jurisdiction of this site at least, if not most of the internet, and is riding off the name and reputation of someone else's work. But it is really up to the Drupal community to enforce it. So far obviously they haven't, but legally they can. Out of respect for the community and copyright law, by saying what I did I was suggesting that you change your brand and save Drupal.org some legal fees. Take it or leave it.

As a third party observer with no affiliation to the drupal.org organisation except as a regular Drupal user I can tell you that you are in direct violation of the Drupal trademark. There are no if, buts or maybes. I am sure that you do it innocently and not through intentional malpractice. By trading on this site you are trading in a North American, European and Australasian environment, where trademarks are defended vigorously. When in Rome do as the Romans.
Show this by changing your brand to something else like koradia.com or grishma.org or you'll have legal fees on top of your current 'debt'. You have a "controversial company name" by choice.

I wish I have read this earlier. I hired Drupalpoint alias Websule (Grishma, Amit and Deep). They promised do deliver a Drupal site in 14 days. After deadline passed they came up with one excuse after the another and stopped communicating. They where very unprofessional from the beginning. No status reports, poor communication (if any) and false promises. I am trying to get my money back right now from Elance escrow.
One thing for sure. After such experiences I will only work with Escrow and no upfront or milestone payments.
Why?
Here is my advice after lots of bad experiences with dishonest coders.
The reason why is very simple. I started this project: "Immigration to Drupal" already 6 times.
The first 2 times I did milestone and upfront payments. The coder's could not deliver as they faced problems with Video encoding and I lost my money. The other 4 times I did not agree to any milestone payments and they could not deliver either but at least I did not loose money (but valuable time). My project will not have any value for me unless it is delivered in fully working order.
With milestone payments I feel like I am paying for coder education. Coders with less experiences they just take projects they are not sure if they can do it or not. And that is just because they get payed some upfront and then milestone payments. They are safe at all times. What about the customer. Customer takes all the risk. That can't be fair.
I believe if a coder who is confident in his skills and sure he can deliver should not have any problems with escrow (Elance, RentACoder, Drupallancers, GetACoder...)

I just got contacted by a gentleman who wanted to know what my experience was like building Project Opus with DrupalPoint.
"Who? Donat Group built that site."
A quick Google and presto, yep there it is Project Opus being listed under their portfolio.
Clearly Grishma Koradia and his company are frauds. Although they are not overly clever ones, they clearly have caused and are causing damage.
